What is the Unlawful Internet Gambling Enforcement Act?

The Unlawful Internet Gambling Enforcement Act, or UIGEA, is a federal law passed in 2006 designed to protect consumers and prevent money laundering and fraud through online gambling. The act prohibits individuals in Tennessee from accepting payments in connection with illegal internet gaming. It also requires banks and other financial institutions to establish procedures to help identify and prevent payments related to unlawful internet gambling. The UIGEA defines unlawful internet gambling as betting on any game where the chance of winning depends on the outcome of an event outside of an individual’s control, such as the lottery, sports betting, and online poker. The act does not include social gambling, skill-based games, or online fantasy sports, which are legal in Tennessee. The UIGEA also established penalties for financial services companies that process payments related to unlawful internet gambling. Financial institutions face fines if they fail to comply with the regulations. Individuals who accept payments related to unlawful internet gambling may also face criminal penalties. The purpose of the UIGEA is to prevent illegal gambling activities conducted online, and to protect consumers from fraud and abuse. Its implementation is closely monitored by state and federal banking regulators, and is enforced by the Department of Justice. By providing strict guidelines and appropriate penalties, the UIGEA helps ensure that online gambling activities are conducted in a safe and secure manner.
