What are the laws governing boating accidents?
Boating accidents that occur in North Carolina are governed by state law and regulations. Boaters are required to have a valid license from the U.S. Coast Guard and have the appropriate safety equipment on board. All boaters must obey navigational rules, use caution when operating a vessel, and operate the boat in a safe and prudent manner. When an accident occurs, North Carolina requires the operator of the vessel to stop the boat and immediately contact the police. In the event of a collision, North Carolina law requires a wreckage report to be filed with the state’s Wildlife Resources Commission. The report must include information about both vessels, witnesses, and details about the accident. Boaters are also required to provide assistance to any injured party. Negligent boat operation may include reckless or careless operation of a vessel, operating a vessel while under the influence, operating a vessel without proper safety equipment, and operating a vessel at an unsafe speed. North Carolina law also sets out the consequences for failing to follow the rules.
