What are the laws governing boating accidents?
In Tennessee, boaters are responsible for following all state and federal laws, regulations, and safety guidelines when operating a boat. Boating accident laws are similar to those governing automobile accidents. Boaters must obey all navigational and safety rules and regulations while operating a boat. If a boater is involved in an accident, they must stop their boat and render help to any injured persons. The boater must also provide all reasonable assistance, such as medical and legal assistance, to the injured persons. Tennessee boaters must report any boating accident that results in injury, death, or property damage to the proper state agency, as well as the local police. Boat operators must also have a valid and in-date boat registration and provide proof of insurance when requested. Although proof of insurance is not required to register a boat, it is recommended. If a boating accident results in injury or death of another person, the operator may be liable for damages, such as medical or funeral expenses, suffered by the other party. All boaters must also be aware of and take steps to prevent alcohol-related boating accidents. In Tennessee, it is illegal for any boat operator to have a blood alcohol content of 0.08 percent or higher, and those who do can be subject to legal penalties. Additionally, any person under the age of 18 operating a boat must be supervised by a person who is at least 21 years old.
