Who is responsible for covering the costs of a boating accident?
In New York, the state’s boating accident law holds the operator of a boat responsible for the costs of an accident. Those operating a boat must be licensed and insured in order to cover the costs of any injuries or damages caused by their boat. If the boat you were operating at the time of the accident is registered in your name, then you are responsible for covering the costs of it. This includes medical bills, property damages, and any legal fees. Often times, the insurance company of the person operating the boat will cover the costs of the accident. However, if the operator does not have sufficient insurance coverage, then they may be held liable for the costs out of their own pocket. In some cases, a third-party may be held responsible for covering the costs of the accident. This third-party may be the manufacturer, owner, or operator of the boat, or even a party who has provided negligent advice or guidance that led to the accident. Ultimately, it is the responsibility of the operator of the boat to ensure that they are adequately covered if an accident were to occur. Failing to do so can result in the operator being held liable for the costs of the accident, which can be very costly.
