What is a closed head injury?

A closed head injury is an injury to the head that does not involve an open wound to the skull. This type of brain injury is caused by a direct blow to the head or a violent shaking of the head and upper body. This causes the brain to strike the inside of the skull, creating bruising and swelling of the brain tissue. The most common causes of closed head injuries are motor vehicle accidents, falls, and sports-related injuries. In Texas, if a person has a closed head injury, they may be able to seek legal action under brain injury law. Brain injury law provides a way for people who have suffered a closed head injury to seek compensation for medical costs, rehabilitation costs, loss of wages, and emotional distress. If the injury was caused by another person’s negligence, brain injury law may also provide for punitive damages to punish the negligent party. In order to obtain compensation as a result of a closed head injury, victims must prove that their injury was caused by negligence on the part of another party. To do this, victims must show that the other party breached a duty of care and that this breach directly caused the resulting injury. In order to prove negligence, victims should consult an experienced brain injury lawyer who can help build a strong case.
