What is mild traumatic brain injury (MTBI)?
Mild Traumatic Brain Injury (MTBI) is an injury to the brain caused by a blow to the head or a jolt that causes the brain to move rapidly within the skull. It is the most common type of traumatic brain injury and is often referred to as a “concussion.” A concussion is a type of MTBI where the impact causes temporary loss of conscious, confusion, and/or amnesia, typically for no more than a few minutes. Symptoms vary from person to person, and may include headaches, dizziness, fatigue, and difficulty remembering or concentrating. In Texas, the state law permits a person who has suffered a mild traumatic brain injury as a result of an accident to pursue a legal claim for money damages. If the injury is severe enough to cause permanent disability, then a person may be able to pursue a claim for more money. In order to succeed in a claim for damages as a result of an MTBI, a person must prove that the injury was caused by the fault of another person or entity.
