What is the difference between a settlement and a verdict in a brain injury case?
A settlement and a verdict are two different outcomes of a brain injury case in Kansas. A settlement is essentially an agreement between the defendant and the plaintiff that both parties agree to outside of the courtroom. The defendant will usually agree to pay a certain amount of money to the plaintiff to cover damages and medical expenses incurred due to the brain injury. A settlement is a voluntary agreement and is often reached without the need for a court trial. A verdict, on the other hand, is the result of a court trial in which a jury decides whether the defendant is guilty of causing the brain injury and what amount of compensation should be awarded to the plaintiff. After the jury has heard the evidence, they will decide on a verdict which can either be in favor of the defendant or the plaintiff. The amount of compensation awarded by the jury may be more or less than the amount of the settlement. Therefore, the main difference between a settlement and a verdict in a brain injury case in Kansas is that a settlement is a voluntary agreement reached between the defendant and the plaintiff outside of the courtroom, while a verdict is the decision of a court trial jury which can only be awarded after a court trial has been held.
