What is copyright law and what are the implications of its violation?

Copyright law is a set of laws that provide creators and owners of creative works with exclusive rights to control how their work is used and distributed. In Louisiana, copyright law is enforced through the federal Copyright Act of 1976, as well as the Louisiana state copyright statutes. Under copyright law, an original work of authorship is automatically protected upon its creation. This means that the owner has the exclusive right to reproduce, distribute, display, perform, license, or create derivative works based on the original work. Copyright law also allows for remedies if copyright is violated. Violation of copyright law can lead to civil or criminal penalties. Civil penalties for copyright infringement can include actual damages (economic losses) or statutory damages in the amount of up to $30,000 per work. Criminal penalties may include fines ranging from $250 to $25,000 for each act of copyright infringement, as well as up to five years in jail. In addition to legal punishments, copyright infringement can result in significant reputational damage to the infringing party, which can be very damaging to one’s personal and professional credibility. Because of this, it is important that those who are creating and using creative works understand and adhere to copyright law in order to avoid any penalties or reputational harm.
