How long do I have to file a burn injury claim?
In the state of Florida, individuals who have suffered burn injuries are generally allowed to file a claim within 4 years of the date of the incident. This 4 year limitation period is set by the state statute of limitations, which is the legal rule that sets the maximum amount of time you have to take legal action. However, it is important to note that there are some exceptions to this rule. In some cases, the statute of limitations can be paused, meaning that the 4 year window may not begin until a certain event occurs (for example, when you reach the age of majority). Additionally, individuals with mental disabilities may be granted additional time to file their claim. Although filing a claim within the statute of limitations is the preferred method, it is also possible to bring a claim after the 4 year period has passed. However, doing so requires a compelling justification, and you are more likely to face a legal challenge. In any case, if you or a loved one has sustained a burn injury, we strongly advise that you consult with an experienced attorney as soon as possible, regardless of how much time has passed. The longer you wait, the harder it may be to prove your case.
