What is the process for filing a lawsuit?
If someone in Oklahoma needs to file a lawsuit, they must go through a legal process. This process is known as litigation. The first step in the litigation process is to consult with an attorney. An experienced attorney can provide advice and guidance on the best course of action for the potential lawsuit. After consulting with an attorney, the next step is to complete the necessary paperwork. Depending on the type of lawsuit, this paperwork may include complaints, summonses, and other documents. Once the paperwork is complete, it must be filed in the appropriate court. The plaintiff, or person bringing the lawsuit, is the one responsible for filing the paperwork. After the paperwork is filed, the defendant, or person being sued, will need to respond to the lawsuit. Again, an attorney can provide guidance and help during this process. If the defendant takes no action, a default judgment may be entered in favor of the plaintiff. If the case is not resolved through an agreement between the plaintiff and defendant, the court may require a trial. During the trial, both the plaintiff and defendant will have the opportunity to present evidence and testify to support their argument. After both sides have presented their cases, the judge or jury will decide how to resolve the case, often in the form of a judgment for the plaintiff or defendant.
