What are the requirements for employee benefit plans?
In Massachusetts, employers are required to provide certain employee benefits as part of their employee benefits plans. Specifically, employers in Massachusetts must offer an employee health insurance plan that meets the requirements of the Massachusetts Health Care Reform Law. This requires employers to provide coverage for medically necessary preventive care, hospitalization, and surgical services, as well as prescription drugs, vision, and mental health services. Additionally, employers must provide employees with a minimum of three weeks of vacation time per year, and must provide sick time and maternity leave for eligible employees. Employers must also comply with the Massachusetts Employment Leave Act, which requires employers to provide employees with up to 16 weeks of job-protected leave in any 12-month period for eligible employees. This leave may be taken for medical or family reasons, such as to care for a new child, for the care of a parent or elderly family member, or to attend a family member’s funeral. Finally, employers must provide their employees with a retirement plan that meets the state’s minimum requirements. This includes both a defined-benefit plan and a defined-contribution plan. In a defined-benefit plan, employers must specify the amount of money they will contribute to their employee’s retirement account each year, as well as the total amount the employer will contribute over a specific period of time. Employers are also required to provide their employees with workplace safety training in order to ensure a safe working environment.
