What is the process for registering a trademark?

In Hawaii, registering a trademark is a process that begins with a trademark search. This search is done to make sure that your mark is not already in use by another company. This search is an important step in order to not infringe on an existing trademark. Once you have conducted a trademark search and determined that your mark is clear, you can register it with the State of Hawaii’s Department of Commerce and Consumer Affairs. To do this, you must file an application with the department’s Office of the Trade Commissioner which includes the following information: a description of the mark, the goods or services it covers, and the name and address of the applicant. The Trade Commissioner will then consider the application and issue a Certificate of Registration if the mark is approved. This certificate is proof that the mark is registered with the State and the applicant is the rightful owner. The Certificate of Registration should be kept on file and is valid for five years, with the option to renew. Once the mark is registered, you must protect your trademark rights by regularly monitoring the market for infringement, adequately responding to any infringement that you discover, and remaining vigilant in protecting your mark and its usage. Taking these steps will help to keep your mark protected and provide legal recourse if infringement is found.
