What is the process for registering a trademark?

A trademark is a type of intellectual property that is associated with a specific product or service. It is a brand name, logo, or slogan that is used to distinguish the goods and services of a company from its competitors. In Texas, the process for registering a trademark begins by filing an application with the United States Patent and Trademark Office (USPTO). When submitting an application, applicants must include various types of information, including the name of the company or person who is applying for the trademark, the type of product or service the mark will be used for, and the class of goods or services the trademark applies to. Applicants must also supply a specimen of the mark they are seeking to register and complete a question-and-answer form. If there is a potential for customer confusion, the application may be rejected. This publication will also allow any party to challenge the mark within 30 days. If there are no successful challenges, the USPTO will issue a certificate of registration, which grants exclusive rights to use the trademark throughout the United States.
