What are the legal rights of a child in an immigration detention center?

In Washington, a child’s legal rights while in an immigration detention center depend on their age and their legal status. In general, all people, including children, have the right to be treated humanely and to be free from physical and psychological abuses in a detention center. Children, regardless of their legal status, have a right to medical care, education, and religious freedom while in a detention center. They are entitled to be protected from harm, abuse, and exploitation and can access legal services if they wish to do so. Detained children also have the right to communicate with family members, friends, and legal representatives, including attorney services. Children are allowed to have personal belongings, even if they are in a detention center, and can receive visits from family members, friends, and non-profit organizations. They must also be able to access age-appropriate recreational activities in the center. In addition, children in an immigration detention center may have additional legal rights due to their age or legal status. For example, unaccompanied children may have additional rights, such as the right to request asylum. Other children may be eligible for specialized protection and assistance programs, such as Deferred Action for Childhood Arrivals (DACA). No matter what their age or legal status, all children in an immigration detention center have the right to the protection and security of the law. In Washington, Child Advocacy Law can provide assistance to ensure that children’s rights are respected and upheld in a detention center.
