What legal protections are available to children in cases of labor exploitation?
In New York, children who are victims of labor exploitation are protected by New York state laws, as well as federal laws. The New York State Child Labor Law protects children by setting standards for the types of work children can do, how many hours they can work, and at what age they can begin working. Furthermore, New York’s Human Trafficking Law makes it illegal to exploit or enslave anyone for labor, services, or sexual acts. The Fair Labor Standards Act (FLSA) is a federal law that sets a minimum age for employment, as well as ensures that those who are employed are paid the federal minimum wage and overtime wages when applicable. Additionally, the FLSA also provides for “child labor standards” which regulate the types of jobs, hours worked, and overtime hours worked by children. In addition to legal protections, there are also organizations that are dedicated to providing support and resources for young victims of labor exploitation in New York such as the Coalition Against Trafficking in Women. These organizations work to increase awareness of labor exploitation and the legal protections available to those affected. They also provide services such as legal representation, medical and mental healthcare, and safe housing.
