Is it legal to buy cannabis in my state?
No, it is not legal to buy cannabis in the state of New Jersey. Although the use of medical marijuana has been legalized in New Jersey since 2010, the sale of cannabis and recreational use of cannabis is still not allowed. Possession of small amounts of cannabis (less than 50 grams) is considered a disorderly persons offense, punishable by up to six months in jail and a $1,000 fine. Possession of larger amounts can result in harsher penalties, including a felony charge. The only exceptions to this rule are for some patients who are registered with the New Jersey Department of Health-Office of Medicinal Cannabis Regulatory Affairs. These patients can purchase cannabis from a state-regulated dispensary that is permitted to sell cannabis products for medical use. It is worth noting that many of the laws surrounding cannabis are still evolving. In November 2020, New Jersey voters overwhelmingly approved a referendum to legalize recreational cannabis, but the state legislature has yet to pass legislation to make that happen. As such, cannabis remains illegal in the state of New Jersey for recreational purposes.
