In Delaware, the penalties for providing cannabis to minors are severe. According to Delaware’s Controlled Substance Act, the act of “selling, giving, delivering, or providing” cannabis to a minor is a felony offense. A person convicted of providing cannabis to a minor, or any other violation of Delaware’s cannabis laws, is subject to a fine of up to $25,000 and/or a term of imprisonment for up to fifteen (15) years. Even more serious penalties can be imposed when the minor is under the age of eighteen (18). In such cases, a person convicted of “selling, giving, delivering, or providing” cannabis to a minor is likely to receive a fine of up to $50,000 and/or a prison sentence of up to twenty-five (25) years. Beyond criminal penalties, a person found guilty of providing cannabis to a minor can also expect to suffer a loss of other rights and privileges. Such individuals may be prohibited from engaging in certain recreational activities, be prevented from obtaining certain types of employment, or have their driver’s license revoked or suspended. Furthermore, anyone found guilty of providing cannabis to a minor may be subjected to community service or additional counseling, as well as other court-mandated penalties.
