Does my state have laws that regulate the use of cannabis in the workplace?
In Nebraska, the use of cannabis in the workplace is regulated by the state. The Nebraska Hemp Farming Act of 2020 prohibits the use of cannabis in the workplace and requires employers to notify their employees of the law. Additionally, employers are allowed to enforce a policy of zero tolerance for the use of cannabis in the workplace, as long as they have a clearly written policy in place that is communicated to their employees. Employers may establish drug-free workplace policies that meet or exceed Nebraska’s cannabis laws, such as drug testing, enforcing zero tolerance policies or prohibiting cannabis use on the job. Employers may also be responsible for enforcing any restrictions imposed by federally mandated drug-free workplace programs. The Nebraska Hemp Farming Act of 2020 also requires employers to ensure that any employee who is found to have violated the law is disciplined in a manner consistent with the employer’s drug-free workplace policy. Failure to comply with the Nebraska Hemp Farming Act of 2020 by employers could result in substantial penalties, including fines. As such, employers in Nebraska should be aware of the cannabis laws in the state and ensure that all of their employees are aware of them as well.
