Are there any laws concerning the sale of cannabis paraphernalia?
In Texas, it is illegal to possess, sell, or purchase cannabis paraphernalia. This includes items such as pipes, bongs, vaporizers, and rolling papers. It is also illegal to advertise the sale of such items. This includes advertising in print, digital, or broadcast media. It is not legal to give away cannabis paraphernalia either. The Texas Controlled Substances Act makes it a crime to distribute drug paraphernalia to people who are under 18 years old. The Act states that no person or company shall sell or deliver any drug paraphernalia to any person under the age of 18 who is not accompanied by an adult guardian. The Texas Health and Safety Code also makes it illegal to possess, manufacture, deliver, or possess with intent to deliver any drug-related paraphernalia, including cannabis paraphernalia. It is a Class A misdemeanor punishable by up to one year in jail and/or a fine of up to $4,000. A second offense is considered a felony with a more serious punishment. Overall, it is very important to remember that the sale, possession, or distribution of cannabis paraphernalia is illegal in Texas. People found in breach of these laws can be issued with a fine or jail time.
