Are there restrictions governing the advertising of cannabis products?
In Pennsylvania, advertising of cannabis products is highly regulated. Under state law, cannabis dispensaries cannot advertise in any form of media – print, radio, television, or digital – that is accessible to those under 21 years of age. This includes billboards, flyers, and websites. Additionally, the content of any advertising must also be in line with the state’s regulations. Advertisements cannot make any health or therapeutic claims, cannot be false or misleading, and cannot contain any elements that would attract minors or encourage them to use cannabis. Furthermore, cannabis advertising is limited geographically. Ads are prohibited in a 1,000 feet radius from any school or daycare facility. On public transportation vehicles, advertising may be allowed as long as it does not appear in any form that can be seen by minors. Lastly, dispensaries must make sure that all of their advertising efforts do not violate the Pennsylvania Medical Marijuana Act. Failure to comply with these restrictions can lead to fines and penalties, including the suspension or revocation of their license. Therefore, cannabis dispensaries must be mindful of what they are advertising and where the ads are going.
