What is criminal appeal law?

Criminal appeal law governs the process of appealing a criminal conviction or sentence. In Maine, criminal appeal law is governed by the Maine Rules of Appellate Procedure (MRAP) and the Maine Constitution. Criminal appeal law allows a person convicted of a crime to challenge the conviction or sentence in a higher court. The convicted person is known as the appellant. An appeal is different from a trial, as the defendant is not re-tried and no new evidence is presented. Criminal appeal law requires that the appellant file a “Notice of Appeal” that states the reasons why the conviction or sentence should be overturned. In Maine, the Notice of Appeal must be filed within twenty-one days of the conviction. In some cases, a criminal appeal can be taken to an even higher court. The Supreme Judicial Court, which is Maine’s highest court, may choose to review appeals from lower courts. Criminal appeal law is an important part of the criminal justice system. It provides a mechanism for those who have been wrongly convicted or given an excessive sentence to challenge their convictions or sentences.
