Does it cost money to file a criminal appeal?

In Washington, filing a criminal appeal typically does cost money. Depending on the type of court in which an appeal is filed, a fee may be required for filing the appeal. For instance, appeals to Washington’s Court of Appeals require a filing fee of $350. Similarly, appeals to the Washington Supreme Court require a filing fee of $400. Washington also requires a service fee for each party served with the notice of appeal. In some cases, an indigent defendant may be allowed to file an appeal without paying the filing fee. For this to be granted, the defendant will need to file a motion to waive the fees, as well as a financial affidavit that shows the defendant is indigent. The court will review documents submitted by the defendant and make a decision on whether the fees will be waived. In addition to filing fees, there may be costs associated with the appeal, such as attorney fees or costs for transcripts or record copies. When an appeal is filed, the court may issue an order for the appellant to pay some of the costs associated with the appeal, although the court may waive these costs if the appellant is indigent. Ultimately, it can cost money to file a criminal appeal in Washington, but the court may waive the fees or costs associated with the appeal if the defendant can demonstrate that they are indigent.
