What are the grounds for a motion for a new trial?

In Alabama, when filing for a new trial, also known as a motion for a new trial, the grounds must show that the previous trial was unfair, or that the appellant was denied due process. A motion for a new trial may be used to fight a criminal conviction. There are several grounds for a motion for a new trial in Alabama. These grounds are evidence that the appellant’s rights were denied, due to the trial court’s errors in law or fact, or by improper actions of the trial court. A new trial may also be granted if newly discovered evidence arises that could not have been discovered before the first trial and which could change the outcome of the first trial. The following are the grounds for a motion for a new trial in criminal cases where the verdict could have been affected: 1) The verdict was contrary to the law or the evidence was insufficient to sustain the verdict; 2) Newly discovered evidence arises that was not available before the trial and could have possibly changed the outcome; 3) The trial was conducted unfairly or a decision by the judge was incorrect; 4) The appellant was denied due process or a constitutional right; 5) Jury misconduct occurred or the verdict was not supported by the evidence; 6) The court’s charge to the jury was wrong; 7) The judge made a mistake in accepting or rejecting evidence; 8) The appellant’s access to justice was denied, or the process was not conducted properly; 9) The court failed to competently, objectively, and fairly address a legal issue or the jury was wrongly instructed; 10) The appellant was denied basic procedural safeguard.
