What is an appellate brief?

An appellate brief is a document that is written by the party appealing a court’s decision and submitted to a higher court in the hopes of overturning that decision. In the state of Maryland, this document outlines the legal argument for why the higher court should reverse the lower court’s decision. Generally, the brief discusses the facts of the case, the arguments and evidence given by both parties, and the lower court’s interpretation of those facts, as well as the legal reasoning that should be applied to the case. The appellate brief must clearly and concisely make a legal argument as to why the decision of the lower court should be overturned. It typically includes the appellant’s argument first, followed by the arguments of the appellee. In Maryland, it is important to include citations to existing law in order to support your claims. The appellate court may also look for references to cases similar to the one being appealed. The appellate brief is a key document in the criminal appeal process in Maryland. It allows the higher court to understand both the appellant’s and the appellee’s arguments so that the court can make an informed decision about the merits of the appeal. As such, it is essential that the appellant’s brief be clear, accurate, and well-supported in order to increase the likelihood of success.
