What is a motion for stay of execution?

A motion for stay of execution is a legal request submitted to a court of law to put a temporary hold, or “stay”, on an execution. In Virginia, such motions are usually filed by criminal defendants who have been sentenced to death in a criminal case. When a motion for stay of execution is filed, the court can grant a temporary hold on the execution until the defendant has exhausted his or her appeals. When a motion for stay of execution is filed, the court must decide whether or not to grant the stay. Factors the court considers when making its decision include the merits of the defendant’s case, the likelihood of success on appeal, and the prejudice which might be caused to the defendant if the stay is not granted. The court also considers whether the delay caused by a stay of execution would violate any constitutional rights or laws. In Virginia, if the court grants the motion, the stay is usually in effect until the appeals process is complete. If the appeal is successful, the death sentence is typically vacated and the defendant is resentenced to a prison term, or the conviction is reversed. If the appeal is unsuccessful, the stay of execution is lifted and the defendant’s execution may be carried out. It is important to note that although a motion for stay of execution is a critical tool for criminal defendants in Virginia, the courts are not obligated to grant the stay. It is ultimately up to the court’s discretion as to whether or not the stay will be granted.
