How do I request a rehearing on an appeal?
In Oklahoma, if you want to request a rehearing on an appeal, you should file a motion with the Oklahoma Court of Criminal Appeals. The motion must state the reasons why you believe the Court should reconsider its decision and must be filed within ten days of the Court’s judgment. You must also provide copies of the motion to the court and to all parties that were involved in the original appeal. Your motion should state specifically the points or issues that you believe the Court failed to consider or consider adequately in its decision. You should include any new evidence, legal arguments, or other information that wasn’t considered by the Court at the time of its ruling. Once the motion is filed, the Court may decide whether or not to grant a rehearing. If the motion is granted, the Court will issue an order for a rehearing. At the rehearing, all parties will be able to present their evidence and arguments to the Court again. The Court will then decide whether or not to uphold or reverse its original decision. If the Court decides to uphold its original decision, you can then appeal the decision to the Oklahoma Supreme Court. Whatever the outcome, you should always seek expert legal advice before filing a motion for rehearing.
