How do I request a rehearing on an appeal?
If you wish to file a request for a rehearing on an appeal in South Carolina, you must file a petition for rehearing with the court where the appeal was originally heard. You must do this within fourteen (14) days of the court’s opinion. The petition should explain why the court should reconsider the case. When the petition is filed, a copy should be mailed to the opposing party. The clerk of the court will then provide a copy of the petition to the court. A judge will then review the petition and determine whether to grant the petition and set a date for the rehearing. If you are not satisfied with the outcome of the rehearing, you may appeal the rehearing decision to the Supreme Court of South Carolina. This must be done within thirty (30) days of the rehearing decision. You must provide the court with a copy of the original petition for rehearing, the decision from the rehearing court, and all documents related to the original appeal. It is advisable to consult with a qualified attorney who is experienced in criminal appeal law in South Carolina before filing the petition for rehearing and appealing the decision. An attorney can ensure that your petition adheres to the proper court procedures and meets the necessary requirements for the rehearing and appeals process.
