How does liability for a car accident get determined?

In Oklahoma, liability for a car accident is determined based on who was negligent and caused the accident. Negligence is when a person fails to act responsibly or takes action that causes harm to someone else. To decide who is negligent and liable for a car accident, the courts will look at several factors including: which of the drivers failed to obey the traffic laws, which of the drivers failed to drive with reasonable care for the safety of others on the road, and any other contributing factors to the accident. In addition to examining who was negligent, the courts will assess the level of damages inflicted in the accident. Damages are monetary awards given to an injured person, or their family, to compensate for losses that occurred due to the accident. These damages can include medical bills, lost wages from missed work, and pain and suffering. The court will also look at how much of the responsibility can be assigned to each party involved in the accident. This is known as “comparative negligence” and is a method of assigning fault and responsibility to different parties in an accident. If both drivers are found to have been negligent, the court will assign some level of fault to each driver and the compensation will be divided accordingly. In Oklahoma, the court will look at all of these factors to determine who is liable for a car accident. Once liability is determined, the responsible party must provide compensation to the injured party to cover the damages incurred.
