What if two or more people are at fault for the same accident?

In North Carolina, if two or more people are found to be at fault for the same car accident, the law states that each party is held to their fair share of the fault. This means that if one person is held to be 50% at fault and another person is held to be 25% at fault, then each person must pay their respective portion of the cost for repairs, medical expenses, and other damages caused by the accident. To determine who is at fault for an accident, investigators may look at the facts of the accident, such as whether someone was speeding or driving under the influence, as well as any other factors that may have contributed to the accident. Additionally, North Carolina law considers contributory negligence, which means that even if someone was only partially at fault for the accident, they can still be held liable. It is important to remember that both parties who are at fault for the same accident are responsible for their own contributions to that accident. If one party has insurance to cover the costs of any damages, that party’s insurance may be able to cover the cost of damages for both parties. Alternatively, each party can be held individually responsible for their fair share of the damages.
