What are the different types of car accident claims?
In Alaska, there are three main types of car accident claims: personal injury, property damage, and uninsured/underinsured motorist claims. Personal injury claims are the most common of the three. These claims compensate individuals who have been injured in an automobile accident, such as if they sustain broken bones, whiplash, or a back injury. The goal of these claims is to have the injured party compensated for medical bills, lost wages, and other losses that resulted from the accident. Property damage claims are for those who have had their vehicle or other property damaged due to another person’s negligence. If, for example, another driver crashes into a parked car, the owner of the damaged car can make a claim to have their property either fixed or replaced. Finally, uninsured/underinsured motorist claims are when someone is injured in an accident with a driver who does not have enough insurance to cover their damages. This claim helps to ensure that the injured party receives the full amount of compensation they are due. In addition to these three main kinds of claims, there are other types of car accident claims that may be filed in Alaska. These can include claims of wrongful death, strict liability, gross negligence, and negligent entrustment. Each of these claims requires different elements to be proven in order to be successful.
