What are the different types of car accident claims?

In California, there are several types of car accident claims that may be pursued in the event of an injury or death caused by a car accident. The most common type of claim is a negligence claim. Negligence occurs when one party fails to properly use reasonable care while driving, resulting in an accident in which someone else is injured. In a negligence claim, the driver who was at-fault for the accident must be responsible for the victim’s losses or injuries. Other types of car accident claims that may be considered in a court of law include product liability or a breach of warranty. Product liability occurs when the car or another part of the car is found to have been defective or had a manufacturing defect, causing the accident. A breach of warranty is when a manufacturer fails to produce a safe car or when the car fails to live up to the safety standards and warranties that were promised. This type of claim holds the manufacturer responsible for any resulting losses or injuries. In some cases, a plaintiff may seek a claim for emotional distress or loss of consortium. These types of claims are filed when the accident has caused emotional and/or mental suffering for the victim or for the victim’s family. Loss of consortium refers to a loss of companionship or the relationship between partners or family members, which has been adversely affected by the accident. Finally, a claim for punitive damages may be sought in some cases. Punitive damages are meant to punish the at-fault driver for their negligence and are awarded as an additional form of compensation. These types of damages are not meant to compensate the plaintiff for any losses, but rather to deter the at-fault driver or any other drivers from repeating the same behavior in the future.
