What is the difference between a catastrophic injury claim and a wrongful death claim?
A catastrophic injury claim and a wrongful death claim are both legal areas of practice in Florida, but they are very different from each other. Catastrophic injury claims are used to seek compensation for major injuries that have resulted in permanent disability or loss of life. These types of injuries typically involve major medical expenses, significant physical and emotional pain and suffering, and a reduced quality of life. Examples of catastrophic injuries include paralysis, traumatic brain injury, severe burns, and amputations. On the other hand, wrongful death claims are used to seek compensation for the death of a loved one due to the negligence of another party. This type of claim covers things like lost wages, medical bills, funeral expenses, and pain and suffering of the deceased’s family members. Therefore, the main difference between catastrophic injury claims and wrongful death claims is that with the former, compensation is sought for injuries sustained by an individual, whereas with the latter, compensation is sought for the death of an individual due to the negligence of another party.
