What is the legal standard for proving negligence in a catastrophic injury case?

In North Carolina, the legal standard for proving negligence in a catastrophic injury case is the same as it is for any other kind of injury case – the plaintiff must prove that the defendant’s conduct was unreasonable or careless and that this conduct was the direct cause of the plaintiff’s injuries. To prove negligence, a plaintiff must establish the following four elements: duty, breach of duty, causation, and damages. Third, the plaintiff must demonstrate that the defendant’s breach of duty was the direct cause of their catastrophic injury. Finally, the plaintiff must show that they suffered damages, such as medical bills, pain and suffering, or lost wages. If the plaintiff is able to prove all four of these elements, they can establish that the defendant was negligent and that their negligence was the cause of the catastrophic injury. The defendant must then pay damages to the plaintiff to compensate for their losses.
