How much time do I have to file a catastrophic injury claim?
In Florida, if you have suffered a catastrophic injury due to the negligent actions of another, you have four years to file a claim from the date of the injury. If the injury involves medical malpractice, you only have two years from the date of injury or date of discovery of injury to file a claim. This is known as the Statute of Limitations. If you are unable to file your claim for whatever reason, the court may consider an extension of time under certain circumstances.
