What is the difference between a personal injury claim and a catastrophic injury claim?
In New Hampshire, a personal injury claim is a claim filed by an individual who has sustained physical, emotional, or financial harm due to another person’s negligence or deliberate act. Generally, a personal injury claim involves a one-time event, such as an auto accident or slip and fall, that results in an injury. It is important to note that a personal injury claim does not include property damage or medical expenses. Catastrophic injury claims, on the other hand, involve permanent physical, emotional, and/or financial damage that an individual has sustained due to another person’s negligence or deliberate act. These types of cases tend to involve permanent impairments that significantly affect an individual’s quality of life, such as having a limb amputated, becoming paralyzed, or suffering from a traumatic brain injury. In some cases, catastrophic injuries can result in long-term hospitalization, physical therapy, psychological counseling, and even permanent disability. In New Hampshire, filing a catastrophic injury claim typically requires that a much higher burden of proof be met, as the resulting harm is much greater. As such, a catastrophic injury claim can be far more complex than a personal injury claim. Additionally, the potential awards in a catastrophic injury claim are often much greater, which can be beneficial to the injured individual.
