What is a charge-off?

A charge-off is a financial term used to describe a debt that has been unpaid for an extended period of time (generally 180 days or more). In Wisconsin, the state’s Consumer Debt Defense Law provides certain protections for those who have charge-offs on their credit reports. Under this law, creditors are not allowed to collect on a debt that is more than four years old (this is known as the “statute of limitations”). This means that creditors cannot take legal action against the debtor, such as filing a lawsuit or garnishing wages. In addition, creditors cannot report a charge-off to a consumer’s credit report after seven years have passed. This prevents the charge-off from having an impact on the consumer’s credit score for an extended period of time. Finally, creditors are also not allowed to charge interest on overdue payments. In summary, a charge-off is a debt that is considered too old to collect on, and its impact on a consumer’s credit report is limited by the Consumer Debt Defense Law in Wisconsin. This law can help protect consumers from having their credit score negatively affected by charge-offs.
