What is a debt validation letter?

A debt validation letter is a legal document used in West Virginia Consumer Debt Defense Law. It is one of the defense strategies an individual can use to dispute the validity of a debt. The letter is drafted by the debtor and sent to the creditor via certified mail. The letter requests valid proof of the debt and asks the creditor to validate the debt. The letter should include the name of the creditor, the address of the creditor, and the account number of the debt in question. It should also include the date that the debt validation letter is sent and a statement that the debt is being disputed. The letter will also request that the creditor provide the following information: the original creditor, the date the debt was incurred, the original amount of the debt, and any current account information regarding the debt. The letter should also include a request for a response from the creditor within 30 days. If the creditor does not respond within this time frame, the debt is considered invalid in the eyes of West Virginia Consumer Debt Defense Law. The debtor is then no longer obligated to pay the debt. The debt is considered null and void and no further action may be taken.
