What is collection defense law?

Collection defense law is a subset of consumer law which focuses on protecting debtors from the often predatory tactics of debt collectors. It is based in the federal Fair Debt Collection Practices Act, as well as similar state laws. In North Carolina, the law is codified under the Uniform Debt-Management Services Act. These laws provide protections for debtors during the collection process, including limits on how and when debt collectors can contact debtors and punishments for debt collectors who threaten or engage in unlawful behavior. The law prohibits certain actions by debt collectors, including harassing or abusive communications, false statements, and threatening criminal prosecution. Debt collectors may not contact debtors at all hours of the day and night and must provide certain documents and information about the debt when they first contact debtors. Debtors also have the right to dispute a debt or ask for additional information about the debt. Collection defense law was designed to protect consumers from unscrupulous debt collectors who try to take advantage of people in debt. This law provides important protections for consumers, allowing them to dispute debts and get information from debt collectors before they are legally obligated to pay them back.
