What is the Fair Credit Reporting Act (FCRA)?
The Fair Credit Reporting Act (FCRA) is a federal law that sets forth regulations regarding how consumer credit can be reported and investigated by credit bureaus. It is designed to ensure that credit bureaus accurately maintain and make available the information they have about consumers, as well as protect consumers from inaccurate or incomplete information being reported. The FCRA also establishes the rights of consumers to dispute any inaccuracies in their credit reports. In South Dakota, the FCRA is enacted under the Collection Defense Law. This law requires creditors and debt collectors to follow the rules and regulations outlined in the FCRA pertaining to the collection of debts. It also prohibits debt collectors from taking unfair practices when attempting to collect a debt. Such practices may include harassing or abusive language, making false or deceptive statements, or using other unfair collection tactics. The law also requires debt collectors to investigate the accuracy of any information they report about a consumer. Under the FCRA, a consumer has the right to dispute any inaccuracies in their credit report by filing a request with the credit bureau. The credit bureau must then investigate the dispute and, if necessary, inform the consumer of any changes made to their report. The FCRA is an important law that helps protect the rights of consumers by regulating how consumer credit data is collected, reported, and used.
