What is the responsibility of a debt collector with regards to debt collection and accuracy of information?
The responsibility of a debt collector with regards to debt collection and accuracy of information in South Dakota is legally outlined in Collection Defense Law. According to this law, debt collectors must act with fairness and honesty. This requires the debt collector to provide consumers with accurate and truthful information. Additionally, debt collectors must not provide false or misleading information in any way during the process. Debt collectors are also not allowed to use deceptive practices when collecting debts. These practices include threatening individuals with legal action when there is no basis for doing so or making multiple phone calls each day. Additionally, debt collectors must not issue any post-dated checks to consumers if they are not legally allowed to do so. When it comes to accuracy in debt collection, debt collectors must make sure that all information regarding a debt is accurate and up to date. If a debt collector is not sure about the accuracy of their information, they must make sure to check with the consumer before providing any inaccurate information. Debt collectors must also make sure to provide consumers with the opportunity to dispute any information they disagree with. Consumers are entitled to receive a written notice which will outline their legal options and the time frame in which they may dispute any inaccurate information. This must be done within a reasonable amount of time in order to ensure accuracy in debt collection.
