What is Chapter 11 bankruptcy?

Chapter 11 bankruptcy is a type of bankruptcy filing that is available to both businesses and individuals in Utah. It is a reorganization bankruptcy, which means that rather than liquidating a business or individual’s assets to pay off their creditors, Chapter 11 allows them to restructure payments and repayment plans. This type of bankruptcy gives individuals and organizations more time and control in deciding how to handle their debts, and is usually used as an alternative when a traditional Chapter 7 liquidation would not be the best option for the debtor. In order to file for Chapter 11 bankruptcy in Utah, the debtor is responsible for submitting a reorganization plan to the court that explains how they plan to pay creditors in a timely and fair manner. This plan must include details on how the debtors will manage their income and expenses, and must be accepted and approved by the court. Once this plan is approved, the debtor must make the payments specified in the plan. Chapter 11 will also stop creditors from contacting the debtor to collect payments. Although Chapter 11 bankruptcy will remain on an individual or organizations’ credit report typically for seven to ten years, it can offer a path to financial stability. Primarily, it provides individuals and businesses with the opportunity to get out of debt without risking their entire assets and financial security.
