What are the requirements for filing a Chapter 11 bankruptcy?

In North Dakota, the requirements for filing a Chapter 11 bankruptcy are the same as in other states. First, the debtor must submit a petition to the bankruptcy court asking to have their debts reorganized and debts eliminated. The debtor must also provide the court with a list of their creditors, the amount and source of their income, and a list of all of their property. The debtor must also show the court that they can form a plan to pay creditors over time. This plan must be proposed and approved by the court. The debtor must also pay filing and administrative fees to the court and provide a schedule of their future income and expenses. The debtor must also attend a meeting of creditors to answer questions and provide information about their finances. At this meeting, creditors have the chance to challenge the debtor’s proposed plan or ask for additional information. Finally, the debtor must meet all of the requirements of the court in order to complete the Chapter 11 bankruptcy process. This includes attending financial management classes, meeting with the court-appointed trustee, and submitting all necessary documents. Once all of these steps are completed, the court will enter an order confirming the debtor’s plan and debtors will receive a discharge of certain debts under the bankruptcy laws.
