What happens when a Chapter 11 bankruptcy filing is dismissed?

When a Chapter 11 bankruptcy filing is dismissed in Alaska, the debtor’s financial responsibilities to their creditors remain the same, unless the dismissal is due to a settlement or agreement. The bankruptcy court may dismiss the debtor’s filing, if the debtor doesn’t meet the requirements that are set forth in the U.S. Bankruptcy Code, or if the debtor fails to make the payments required by the court. The debtor can seek relief from the debt-relief order when the Chapter 11 case is dismissed. This means that the debtor’s assets will be liquidated and the proceeds used to pay creditors. However, if the debtor has been declared personally insolvent, they may be able to request a court-ordered discharge of their financial responsibilities to their creditors. If the court approves, the creditors’ claims will be extinguished. The court may also remove the automatic stay when the filing is dismissed, which means creditors can continue to pursue legal action in order to collect the debt or garnish wages. Furthermore, creditors can also begin repossessing or foreclosing on any property that was used to secure a loan. The bankruptcy court’s dismissal of the filing will not discharge any of the debtor’s financial obligations, and they will remain liable for the debt they owe.
