How long does a debtor have to confirm a plan in a Chapter 11 bankruptcy?
In Michigan, a debtor in a Chapter 11 bankruptcy case has 180 days to confirm a plan. The 180-day period can be extended if the court orders an extension and the debtor has made a motion to do so. The confirmation hearing must be held at least 30 days prior to the expiration of the 180-day period. The debtor must also provide notice of the confirmation hearing to all parties in interest at least 10 days prior to the hearing. At the confirmation hearing, all parties have the opportunity to present evidence concerning the propriety of the plan. The debtor must establish that the plan meets the requirements of the Bankruptcy Code and that it was not proposed in bad faith. If the court determines the plan meets these requirements, it will confirm the plan. A debtor may also seek to modify the plan after it has been confirmed. The debtor has a period of 45 days to modify the plan after it has been confirmed. However, the court may deny the modification if it finds that the modification is contrary to the public interest. Once the plan is approved and confirmed, the debtor must make all payments according to the terms of the plan. The debtor must also comply with all of the other obligations, such as providing reports and disclosures, stated in the plan. Failure to comply with the plan could result in dismissal of the case.
