How long does a debtor have to confirm a plan in a Chapter 11 bankruptcy?

In Mississippi, a debtor who files for Chapter 11 bankruptcy must confirm a plan within an allotted period of time. This confirmation period is usually 180 days after filing the petition, although it can be extended up to 18 months or more depending on the situation. A confirmation order can be issued at the end of the confirmation period if the debtor has met all of the requirements under the Bankruptcy Code. The Bankruptcy Court has the ability to extend the confirmation period if a debtor is unable to meet the required deadlines, or if the debtor or creditors file a motion to extend the period. The Bankruptcy Court also has the right to extend the period if it finds that the debtor is acting in good faith to complete a satisfactory reorganization plan. Additionally, the Bankruptcy Court can terminate the confirmation period if the debtor fails to file a plan within the allotted time. It is important for debtors to understand all the requirements of Chapter 11 bankruptcy and their obligations to confirm a plan in a timely fashion. Although the confirmation period can be extended, debtors should not rely on the Court to do so as failing to meet deadlines can result in the case being dismissed.
