What is “debtor’s equity litigation” in a Chapter 11 bankruptcy?
Debtor’s equity litigation in a Chapter 11 bankruptcy is a type of legal action brought by individuals or businesses that have filed for bankruptcy protection from creditors. It generally refers to any lawsuit or claim that a debtor has against creditors in an effort to recover a portion of the value of their estate. This type of litigation is often used to try and gain access to assets that would otherwise be protected from creditors in the bankruptcy. In a Chapter 11 bankruptcy in Mississippi, a debtor may have several types of debtor’s equity litigation available to them, such as filing a motion for valuation of the estate or a motion to liquidate assets for reimbursement to creditors. Additionally, a debtor may be able to prove prejudicial treatment by creditors in order to gain compensation or additional assets. The goal of debtor’s equity litigation is to allow the debtor to make the best of their current financial situation and to recoup as much of their assets as possible. This type of litigation is usually only available in Chapter 11 bankruptcies, as other types of bankruptcy proceedings in Mississippi provide little protection for debts and essentially allow creditors to seize assets with little concern for the debtor’s rights.
