How are creditors paid in a Chapter 11 bankruptcy?

In North Dakota, creditors in a Chapter 11 bankruptcy are typically paid in order of their priority in accordance with the Bankruptcy Code. Creditors are divided into two categories: secured and unsecured. Secured creditors have a lien on property owned by the debtor, and they must be paid first before other creditors. Unsecured creditors are not secured by property, and they are paid after the secured creditors. Priority is then determined based on the type of debt owed. Priority debts are those considered essential, such as taxes, child support payments, or alimony, and must be paid first. The bankruptcy court will also set aside a certain amount of money to pay administrative costs associated with the bankruptcy filing. Once secured, priority, and administrative costs are paid, any remaining funds will be distributed to unsecured creditors, who are paid in order of their priority. Unsecured creditors are generally paid a percentage of their debt, though this percentage may vary depending on the assets and liabilities of the debtor. Creditors will be notified by the court of the payment plan for the debts owed to them. The court-approved payment plan is legally binding and creditors must abide by it. If a debt is not paid, the creditor may be able to pursue legal action against the debtor.
