What is investment fraud?
Investment fraud is a type of consumer fraud which occurs when someone uses deceptive or illegal tactics to solicit money or other assets from individuals or businesses. It typically involves offering investments that promise high returns and many times, the offer appears to be legitimate. It can take many forms, such as pyramid schemes, Ponzi schemes, commodity fraud, offering worthless or non-existent securities, and more. In North Carolina, it is illegal to commit any form of consumer fraud, including investment fraud. To be considered an illegal act, the person must have knowledge that the investment was not genuine and must have intended to mislead or deceive the investor. If the person has defrauded someone, they can be held liable for the damages incurred by the investor, including financial losses and emotional distress. Investment fraud is a serious offense and can result in criminal charges. If convicted, individuals can face fines, jail time, and restitution to the victims. Individuals can also be held liable for civil damages such as the money lost, emotional distress, and court costs. In some cases, the victims may also be able to pursue a civil lawsuit in which they can seek damages from the perpetrator. It is important for individuals to understand the risks of investing and to always seek independent advice when considering a financial decision. Additionally, it is important to be aware of any suspicious activity and to report it to the proper authorities. By taking these precautions, individuals can help protect themselves from the threat of investment fraud.
