What is the process for making a written demand for relief under consumer law?
In Hawaii, consumers have certain rights granted by consumer fraud law which provide protections for consumers from fraudulent or deceptive business practices. To make a written demand for relief under consumer law, a consumer must provide their name, address, and a description of the dispute in writing. The demand should also include the amount of money or other type of relief that the consumer is seeking and a timeline in which they expect to receive the resolution. If the business fails to resolve the dispute within the timeline, the consumer can then proceed to file a consumer complaint with the Office of Consumer Protection. Once a complaint is filed, the Office of Consumer Protection will investigate the complaint and contact the consumer and the business in an effort to reach a resolution. If a resolution is not possible, the Office of Consumer Protection may recommend going to court or engaging a mediator to resolve the dispute. Alternatively, the consumer may choose to pursue filing a lawsuit. No matter what course of action is chosen, the consumer should keep accurate records of their written demand for relief, all communications with the business, and any other documents that may be relevant to the dispute. Doing so may help resolve the issue in a timely manner and avoid the need for further legal action.
