What is the difference between class action and individual litigation in consumer fraud cases?

Class action and individual litigation are two distinct processes for dealing with consumer fraud cases in Oregon. Individual litigation is a legal process whereby one person files a claim against a person or business they believe has committed fraud. This process involves filing a lawsuit in court, in which the person can ask for remedies such as monetary damages, an injunction against the wrongdoer from continuing their fraudulent activity, or some other remedy. The case is usually resolved either through a settlement negotiated by the parties or a judge’s decision. Class action lawsuits, on the other hand, are legal processes in which a group of people who have experienced a similar harm due to the same defendant’s actions band together and file a lawsuit as a unit. In class action cases, one or more people, called class representatives, act on behalf of the entire group and their claims are resolved as a group. This is more efficient than handling multiple individual claims in the same situation. In both individual and class action litigation, the victims of consumer fraud may be able to receive damages or other remedies from the wrongdoer. However, class action cases provide a way for a larger number of people who have experienced the same harm to quickly and efficiently resolve their claims.
